Investigators said Scott was wearing a helmet with a blinking red light that night. FHP found probable cause to charge Isabel with felony vehicular homicide. The Broward State Attorney's Office ultimately decided to pursue a lesser charge of misdemeanor reckless driving. In a memo sent to NBC6, prosecutors said video, witness statements and physical evidence showed Isabel was driving recklessly. However, prosecutors said in the memo Isabel was not determined to be the sole cause of the crash because Scott should not have made the turn onto the roadway when he did. Following a Monday morning hearing in Broward County court, NBC6 spoke with Isabel's defense attorney, Joshua Rydell. When someone loses their life, it's a tragedy, Rydell said. Rydell pointed to an initial crash report estimating Isabel was traveling 55 mph, slower than the speeds investigators ultimately determined. So it's a little inconsistent in terms of what FHP has put out in regarding their investigation of this case, Rydell said. Rydell said Isabel is innocent of the reckless driving charge. Officer Isabel has spent his entire career focused on protecting the community, and we firmly believe when all the facts and circumstances come out, he's going to be exonerated of this offense, Rydell said.
