BIRMINGHAM, Mich. - A federal civil rights lawsuit accusing Birmingham police officers of forcing their way into a home, beating a man, and prosecuting him without probable cause has ended in a settlement of over half a million for a former Birmingham resident. I am relatively happy with the outcome, but I still never got to really have my day in court, the man said. I never really got to hear from these officers; they never really had to take responsibility for it. The lawsuit alleged seven counts: excessive force, unlawful arrest, malicious prosecution, failure to intervene, failure to train and supervise, gross negligence, and assault and battery. It also alleged the man suffered chest, back, and facial injuries, severe bruising and contusions, a possible head injury, PTSD, and economic loss. The case brought by a man represented by Fieger Law, who has since moved out of the city and is choosing to remain anonymous for safety and retaliatory purposes, was dismissed with prejudice Sept. 4 -- one day after court records show the City of Birmingham confirmed the settlement of $675,000. I moved out of Birmingham because I was afraid, the man later told Local 4. The dismissal means the case cannot be brought again. The order says any party may ask to reopen the case to enforce the agreement through Nov. 2. It also dismisses several pending motions filed before trial. The allegations The man sued the city of Birmingham and five officers -- Nicholas Hill, Scott McIntyre, Raymond Faes, Anthony Paredes and Nicholas Krumm -- in June 2023. The suit accused the officers of violating the man's constitutional rights during a July 10, 2021, response to a reported domestic violence incident at a home on Bowers Street. According to the lawsuit, officers arrived after the man and his wife had separated after an argument. His wife was sitting in a vehicle hundreds of feet away from the property, while the man was inside the family home, the lawsuit said.
