MEMPHIS, Tenn. (WMC) - Hernandez Govan, the man acquitted of being the mastermind behind the murder of Memphis rapper Young Dolph, is in federal custody, charged with cyberstalking.

His attorney, Claiborne Ferguson, said the timing of the federal charges is  highly suspicious  following Govan's acquittal in the Young Dolph case.

Memphis Police arrested Govan on June 11 on state stalking and harassment charges, a misdemeanor. He was released the next day on a $4,000 bond.

Twelve hours later, federal authorities arrested him on the same charges, which carry a five-year prison sentence in the federal system.

Federal charges follow state arrest

 I find it highly suspicious that the day he's released from custody on bond in state court,  Ferguson told Action News 5,  the Feds file a complaint. The federal government almost never files complaints, they go straight for an indictment. That is wildly unusual, especially on something that would be charged and is charged as a misdemeanor in state court. Somebody really had to go out of their way to get that done. 

A federal magistrate ordered Govan held in custody, believing him to be a danger to his ex-girlfriend, the alleged victim in the cyberstalking case. She was so fearful for her life, Memphis Police and the National Guard protected her house and her child.

According to the federal criminal complaint,  Govan threatened to shoot up her home  because she owed him $540. He called and texted, saying  The National Guard can watch yo house all day...idgaf about no police, national guard or nothing. 

The complaint said  Govan also threatened to post explicit photos of her on social media.  All the threats were made on the same day with Govan proclaiming himself,  bigger than the devil. 

 One of the things we were looking at in the bond hearing,  said Ferguson,  is whether alcohol was involved and that as the day went on, he lost more control over his decision making.
